TERMS AND CONDITIONS
1. Validity and object of regulation
1.1
WMM Hotel Betriebs GmbH provides rooms and rooms exclusively for the following conditions. WMM Hotel Betriebs GmbH does not accept any conflicting conditions.
1.2
If the customer orders contractual services not only for himself, but for his colleagues, employees or other third parties attributable to him, he shall ensure that these persons also comply with the following conditions.
2. Conclusion of the contract
2.1
The contract is concluded by the booking confirmation of WMM Hotel Betriebs GmbH and, if necessary, the timely receipt of the advance payment required by WMM Hotel Betriebs GmbH. If it is not possible to answer the request by means of a booking confirmation, the contract is concluded by providing the service.
2.2
If the booking confirmation deviates from the content of the request, the contents of the confirmation of booking will be the contractual content if the customer does not immediately object to it after receipt. Upon acceptance of the service by the customer, the contract with the amended content comes into being. For bookings through hotel portals, the booking can be made dependent on the deposit of a valid credit card number.
2.3
If a third party has booked for the customer, the third party of the WMM Hotel Betriebs GmbH shall be liable, together with the customer, as jointly and severally liable for all obligations arising from the Customer Agreement.
3. Room access, arrival and departure
3.1
The customer receives an individual room code by SMS and email before starting his / her stay instead of a key. Only with this code, which is valid for the entire duration of his stay, the customer is allowed to access to the building via the main entrance and into his room. For long-term stays longer than 29 days, the customer receives automatically a new code from every 29th day of use.
3.2
Without any other written agreement, a room can not be occupied before 4 pm on the day of arrival.
3.3.
The room must be vacated by 10 am on the day of departure. If the room is not vacated by this time, WMM Hotel Betriebs GmbH is entitled to charge 50% of the full room rate for the departure day by 1 pm at the latest. If the room is vacated after 2 pm, the full room rate can be charged.
4. Services and prices
4.1
Which services and prices are contractually agreed, can be taken from the description of the house on the website and the information in the booking confirmation, which refers to it.
4.2
The prices published in the price section of the website are valid as contract content for the services included in the booking confirmation or requested.
4.3
The agreed prices are inclusive of the taxes and local taxes applicable at the time of conclusion of the contract. Local taxes which are payable by the customer according to the respective municipal law, such as the local tax, are not included, e.g. visitor‘s tax. If the rate of statutory value-added tax changes after conclusion of contract, the agreed price changes accordingly. In the case of contracts with consumers, this applies only if the period between the conclusion of the contract and the fulfillment of the contract exceeds 4 months.
5. Use of the premises
5.1
The subletting or further leasing or other (also free of charge) use of the delivered rooms and premises, as well as their use for other than residential purposes, even at short notice, is not permitted, whereby § 540 Abs. 1 sentence 2 BGB is avoided as far as the customer is not consumers.
5.2
The customer is also not allowed to install fixtures, as well as design, construction or technical alteration of the premises.
5.3
Always observe the applicable reporting regulations. The customer has to register with the competent office in accordance with the provisions of the Notification Act. If the customer orders contractual services not for himself, but for his colleagues, employees or other third parties attributable to him, he has to refer these to the reporting regulations and ensure that the reporting regulations are observed.
5.4
With the exception of a coffee machine, the use of other electric kitchen appliances which are not already in the room is not permitted.
5.5
There is an absolute ban on smoking throughout the building. Should unlawful acts be detected, we penalize this with fines. The customer shall be liable for all losses incurred by WMM Hotel Betriebs GmbH by himself, his guests or other persons for whom he is responsible.
6. Premature termination of contract
6.1
WMM Hotel Betriebs GmbH may terminate the contract without notice if the customer violates the conditions of use as set out in section 5.
6.2
The termination without notice is also possible, if the customer or his guests, do not comply with the house rules.
6.3
Any use of the rooms left to the customer deviating from the agreement shall entitle WMM Hotel Betriebs GmbH to terminate the contractual relationship without notice. The customer is not entitled to reimburse the user fee.
6.4
Termination of the contract without notice is also possible if the premises are booked with misleading or incorrect information about important facts, for example in the person of the customer and the purpose.
6.5
In the event of a terminated termination of the contract, the customer shall not be entitled to claim damages. In the case of termination without notice, the room must be vacated
immediately. If this does not happen, WMM Hotel Betriebs GmbH is entitled to clear the room at the customer‘s expense and to delete the access code.
7. Payment
7.1
The room rate is to be paid at the time of booking, before the room is occupied or, in the case of long-term stays, on the 1st of the month for the current month. Additional services are not included in the room rate and must be paid separately.
7.2
WMM Hotel Betriebs GmbH is entitled to demand a reasonable advance payment or security deposit, e.g. in the form of a credit card guarantee, upon conclusion of the contract by the customer. The amount of the advance payment and the payment dates can be agreed in the contract in writing.
7.3
A delay in payment entitles WMM Hotel Betriebs GmbH to refuse further services from the contract which is still ongoing, as well as to the rescission of contracts for future services. WMM Hotel Betriebs GmbH reserves the right to assert further damages.
7.4
Reimbursement of unused services by the customer is not possible, unless the hindrance has its reason in a circumstance which WMM Hotel Betriebs GmbH has to represent.
8. Cancellation conditions
8.1. Short term stays (5-29 days):
up to 5 rooms - free of charge until 3 days (72 hours) before arrival
5-10 rooms - free of charge until 10 days before arrival
from 10 rooms - free of charge until 4 weeks before arrival
For a cancellation from 3 days before arrival we charge 100% of the total price
8.2 Long-term stays (from 30 days):
up to 5 rooms - free of charge until 2 weeks before arrival
from 5 rooms - free of charge until 4 weeks before arrival
For a cancellation from 4 weeks, or 2 weeks before arrival we charge 100% of the total price
8.3
In case of no show (No Show) or premature departure of the customer after check-in, a refund of the agreed price for all booked services is excluded.
8.4
The total usage price is the confirmed price for the entire period for which the reservation was intended.
8.5
If you have booked via an external booking channel, the cancellation can only be made via the corresponding channel according to the conditions displayed there.
9. Liability
9.1
WMM Hotel Betriebs GmbH is liable for damage caused by the injury to life, the body or the health. Furthermore, it is liable for other damages which are based on an intentional or grossly negligent violation of WMM Hotel Betriebs GmbH or on an intentional or negligent violation of contractual obligations. WMM Hotel Betriebs GmbH is in breach of the law by a legal representative or a vicarious agent. Any further damages claims are excluded.
9.2
The customer shall be liable for all losses incurred by WMM Hotel Betriebs GmbH by himself, his guests or other persons for whom he is responsible. Vandalism in any form or behavior that results in damages will be punished with a complaint and claim for damages.
9.3
In the event that the customer forgets its access code, or relocates or otherwise causes an invalidity of the code culpably and he has to request a new code, a fee of 25,– EUR will be
levied. The costs of any break-in service which may be necessary are defrayed by the customer.
9.4
WMM Hotel Betriebs GmbH accepts no liability in the event of the loss of goods entered by the customer.
9.5
Any abandoned items of the customer will be sent only on demand. The risk and costs are taken by the customer. WMM Hotel Betriebs GmbH reserves the right to charge a processing fee of
10,- EUR in addition to the costs incurred for shipping. The remaining items are max. 3 months. Afterwards the objects, which have an acceptable value, which is apparently at least 10,– EUR, will be handed over to the local fund office. Other items will be destroyed after this period or handed over to a local beneficial organization for use.
10. Verification
10.1
If a service is not carried out or is not carried out in accordance with the contract and is customary, the customer may demand rectification.
10.2
The customer may demand a reduction of the price (reduction) corresponding to the lower rate of performance, if services are not rendered or not provided in accordance with the contract in the event of fruitless demand for remedies. The customer is obligated to do everything possible in case of possible performance problems in order to contribute to a correction of the disturbance and to keep a possible damage low. If the customer does not fulfill these obligations, he is not entitled to claims.
10.3
If WMM Hotel Betriebs GmbH is hindered by force majeure or strike in the fulfillment of its performance, no liability for damages can be derived from this. WMM Hotel Betriebs GmbH, however, is obligated to seek alternative procurement of equivalent services.
11. Handling post/packages
11.1
In principle, WMM Hotel Betriebs GmbH does not offer any possibilities of receiving letters and packages.
11.2
If, nevertheless, a letter or package is sent in error, it will only be carried out at the explicit request of the customer and in return for refund.
12. Special provisions
The following regulations must be observed:
- It is not allowed to wash inside the room
- Pets are not allowed
- Conditions of use for WLAN use
